Heard Sri Shashi Nandan, learned Senior Counsel assisted by Sri Udayan Nandan, learned counsel for the petitioners; Sri R.M. Saggi and Sri Vivek Varma, learned counsel for the respondents.
The dispute relates to premises No. J.M./1/78/66-A, Jajmau Kanpur wherein the factory under the name and style of M/s Zaz Sons Exports is in operation.
Grievance of the petitioners is that the water tax has been enhanced without following the procedure as prescribed by law. Submission is that the enhancement is arbitrary. The dispute relates to the assessment year 2012-13.
By a separate order passed today, we have disposed of Writ Tax No. 324 of 2013 with respect to the house tax assessment.
The present writ petition is also disposed of on the similar terms and conditions as the water tax is proportionate to annual letting value of the building in question subject to deposit of Rs.5,00,000/- (Rupees Five Lakh) within three weeks before the authorities concerned.
