Heard learned counsel for the petitioner, learned Additional Government Advocate and Sri Vivek Srivastava, Advocate holding brief for Sri Ram Raj, learned counsel for respondent no.4, who is not present.
Under Challenge in the instant writ petition is F.I.R. relating to Case Crime No.149 of 2013 under sections 419,420,467,468,218,409,120B I.P.C., police station Dhammaur, district Sultanpur.
We have gone through the F.I.R., which discloses commission of cognizable offence, as such the same cannot be quashed.
However,considering the argument advanced by learned counsel for the petitioner that the allegations levelled in the F.I.R. are trivial in nature, we hereby dispose of this petition with a direction that the petitioner shall not be arrested in the aforesaid case crime number till submission of report under Section 173(2) Cr.P.C., provided he cooperates with the investigation, which shall go on.
