In the present case petitioner is government servant and an order of punishment has been passed by invoking and exercising authority vested under U.P.Government Servant (Discipline and Appeal) Rules 1999. After the order passed by the Disciplinary Authority, petitioner has proceeded to prefer Appeal under Rule 11 of U.P.Government Servant (Discipline and Appeal) Rules 1999 and said appeal in question has been dismissed on 06.02.2013.

Under U.P.Government Servant (Discipline and Appeal) Rules 1999, there is further remedy of Revision under Rule 13 before the State Government and the State Government has got wide authority to pass appropriate order in the facts of the case. In view of this once wide amplitude of authority is vested with the State Government against the order passed by Appellate Authority then this Court cannot permit to by pass the said remedy. 

Consequently, present writ petition is dismissed on the ground of alternative remedy of revision under Rule 13 of the aforesaid Rules 1999.
