We have heard learned counsel for the parties and perused the pleadings of  writ petition.

Learned counsel for the petitioner Shri Shishir Chandra submitted that the petitioner is  aggrieved by the Government Notification which this Court has held to be  contrary to the  observations in the judgment of Allahabad Bench, passed in Writ Petition No. 3199 of 2013 (Pravesh Kumar Vs. State of U.P. and others), vide the judgment and order dated 17.4.2013, in Writ Petition (M/B) No. 3199 of 2013.  Thus, according to learned counsel, the petitioner is also entitled to get the benefits of the said order. Smt. Bulbul Godiyal, learned Additional Advocate General, submitted that in the light of the aforesaid judgment of this Court, the Government has proposed to amend the Rule and the proposal is already under active consideration.

That Being so, we dispose of this writ petition with direction to issue fresh  tender notice after new Rules are framed.  Consequently, we quash the impugned tender.
