Learned counsel for the petitioner contends that the order of suspension of the petitioner, who is serving as Accountant/Acting Secretary, could only be passed by the Committee of Management.  However, order of suspension has been passed by the District Assistant Registrar, Cooperative Societies, and, therefore, is without jurisdiction.

Let counter affidavit be filed within two weeks.

Rejoinder affidavit, if any, be filed within two weeks thereof.

Standing counsel would represent all the respondents. 

List on 29.10.2012.

Till the next date of listing, operation of the order, Annexure-1, shall remain stayed, in case the petitioner has not been relieved.
