Learned counsel for the petitioners, on the strength of government order dated 26.5.2003, Annexure-3, contends that in terms of para-2 of Annexure-3 a person could not have been sent back from deputation before expiry of three years. 

The petitioners joined U.P. Rajya Krishi Utpadan Mandi Parishad on 11.5.2012 on deputation.  Vide order dated 31.8.2012, however, the petitioners are sought to be relieved.

Learned counsel for respondent nos.1 and 2 contends that the said respondents never asked for persons on deputation.  In such circumstances, sending employees on deputation in itself was illegal.

Let counter affidavit be filed within one week from today.

Relevant record in regard to deporting the petitioners alongwith reasons for deporting be also placed on record.
