Learned counsel appearing for the petitioner contends that although the petitioner was serving on contract basis, after engagement of the petitioner vide Annexure-2, dated 18.2.2006, in view of good conduct of the petitioner the contract was extended from time to time.
Vide impugned order dated 24.7.2012 (Annexure-1), the contract has been terminated on the ground that the petitioner has indulged in misconduct in regard to girls.
It has been asserted that although the order makes a reference to an enquiry, however, the petitioner was not associated with any enquiry and opportunity of hearing was not given to the petitioner.
State Counsel would represent respondent nos.1 and 2.
Sri Pradeep Kumar Singh Visen, Advocate has put in appearance for respondent no.3.
Issue notice to serve respondent no.4, returnable in two weeks from today.
Let counter affidavit be filed within two weeks, positively.
Any appointment made on the post held by the petitioner shall remain subject to final decision of this petition.
