Sri Ashish Mishra, learned counsel appearing on behalf of the respondent, submitted that Sri Mohd. Aslam was appointed on 30.11.1997 against the vacancy which arose on 18.1.1995. Learned counsel for the petitioner submitted that once the life of the select list dated 18.7.1993 expired on 17.7.1996, no appointment of any person from the select list could be made after 17.7.1996. If the appointment of Sri Mohd. Aslam could be made after the expiry of the life of the select list on 17.7.1996, the petitioner's appointment can also be considered. The reply in this regard has been filed on 27.9.2012, but the same is not on record. Office is directed to place the same on record.
Learned counsel for the petitioner has filed rejoinder affidavit as well as supplementary affidavit, the same may be placed on record. Learned counsel for the petitioner submitted that he has impleaded Sri Mohd. Aslam as respondent no. 3 and has also taken steps to serve him by registered post.
The office has not given any report in this regard. Office is directed to give report about the service of notice on Sri Mohd. Aslam. In case if the notice has not been served, the petitioner may take steps to serve Sri Mohd. Aslam through District Judge, Mirzapur where he is working.
