The prayer for bail of appellants-Smt. Rahmat Begum, and Jalaluddin is being considered by us after receipt of lower Court records in the light of our order passed on 17.7.2012.

The submission is that on similar evidence other co-accused persons, namely, Salauddin and Chootey, who have preferred two separate appeals  being Criminal Appeal Nos.2983 of 2012 and 2316 of 2012,  have been admitted by the Court. In support of the contention, the orders passed in the connected two appeals granting bail have been produced before us.

Considering the similar facts and circumstances of the aforesaid two appeals and the present one, we direct the release of appellants, namely, Smt. Rahmat Begum and Jalaluddin on bail during the pendency of the appeal on  each of them furnishing  a personal bond of Rs.20,000/- with two sureties of the like amount each to the satisfaction of the Court below concerned.

As regards sentences of fine imposed upon the above named appellants, realization thereof shall remain stayed till further orders.
