Petitioner seeks a writ of mandamus directing the respondents to ensure proper investigation and arrest of all the accused named in the first information report dated 08.06.2012, registered as Case Crime No. 353 of 2012, under Sections 147, 148, 149, 302, 307 and 120-B I.P.C., Police Station-Jagdishpura, District-Agra.

The said first information report has been lodged by the petitioner only on 08th June, 2012.

We have no doubt that the investigating officer shall proceed with the investigation with all promptness and with due diligence. So far as the arrest of the persons named in the first information report is concerned, we are not expressing any opinion at this stage, as it is within the discretion of the investigating officer to arrest such persons, as may be required in view of Section 41 Cr.P.C.

The writ petition is disposed of with the aforesaid observation.
