We have heard Sri Kapil Rathore, learned counsel for the appellants on the prayer for bail of appellants-Heera Singh and Raju Awasthi, whose earlier prayer for bail was dismissed vide Court's order dated 3.11.2008.

Appellant Raju Awasthi is said to have armed with lathi and Heera Singh with a rifle, who caused injuries to the deceased. Other similarly situated accused persons, namely, Budhraj Singh, Kalloo Singh, Latto Singh, Ashok Singh and Karan Singh have been admitted to bail in the connected Criminal Appeal No.645 of 2008 considering that there were general allegations against them as well.

Considering the above facts, we direct the release of appellants-Heera Singh and Raju Awasthi on bail, during the pendency of the appeal, on furnishing a personal bond of Rs.20,000/- with two sureties of the like amount each to the satisfaction of above noted court in connection with above noted trial. 

As regards sentence of fine imposed upon the above named appellants, realization thereof shall remain stayed till further orders.
