We have heard Sri K S Yadav, learned counsel appearing for appellant Deep Singh on his prayer for bail and learned A.G.A. for the State.
The sole submission which was forwarded before us, is that appellant Deep Singh is in custody since the date of judgment, i.e., 18.12.2003. Submission also was that the present appellant along with co-appellant Karan Singh was said to have fired shots at the deceased and injuries were also there. Submission further was that the Court was considering the first prayer for bail of the appellant and there could not be any prospect to the appeal being heard and disposed of,as after 9 years of the conviction of the appellant, the office of the Court has not prepared even the paper book.
Regard being had the years of confinement and the bleak prospect of the appeal being heard, we direct release of appellant Deep Singh on bail, during the pendency of the appeal, on execution of a bond of Rs.20,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Court No. 1, Kannauj in connection with Sessions Trial No. 168/2002.
