Heard learned counsel for the Applicant and learned AGA on behalf of State.
The learned counsel for the applicant has submitted that as per the prosecution case, the applicant has not played any active role in the commission of crime. As per the statement of victim when he was being taken away by the co-accused persons, the applicant was sitting in the Car prior to his abduction. There is also no allegation that he has demanded any ransom either from victim or any other else. The applicant has also not been arrested on the spot.
The Bail Application, however, has already been opposed by the learned AGA.
Having considered the facts and circumstances of the case that the applicant has not played any active role and also has not been arrested on spot, his case is distinguishable from the other accused persons.
In the circumstances, let the applicant Mansa Ram S/o Jamuna involved in Case Crime No.577 of 2011, under Sections 364A, 506 I.P.C., P.S. Bisheshwarganj, District Bahraich be released on bail subject to furnishing of a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
