Learned counsel for the petitioner contends that wife of respondent no.4 is getting house-rent allowance from U.P. Government, as she is also serving in U.P. Civil Secretariat, Lucknow. Under the Rules, respondent no.4 is not entitled to be paid the house-rent allowance. De hors the rule position, respondent nos.2 and 3 have directed the petitioners to pay the house-rent allowance to the respondent no.4.
Respondent nos.2 and 3 are directed to file their affidavit as to under what circumstances directions have been issued to pay the house-rent allowance to respondent no.4.
It is made clear that in case it is found that respondent no.4 is not entitled to house-rent allowance, the amount released to respondent no.4 shall be refundable alongwith interest, to be deducted from the salary of respondent no.4.
