Heard leaned counsel for the appellant and learned A.G.A. for the State and perused the lower court record.
Prayer for bail has been made on behalf of the appellant Anil Kumar, who has been convicted under sections 363, 366 and 376(I) I.P.C. by learned Additional Sessions Judge / F.T.C., court No.-31, Barabanki, in Sessions Trial No. 711/08 arising out of Case Crime No. 506/08 P.S. Bardupur, District - Barabanki, and sentenced to 8 years R.I. with fine.
It is submitted by the learned counsel for the appellant that the appellant was arrested on 29.8.2008 and since then he is in custody. The appeal is also not likely to come up for final hearing in near future.
Learned A.G.A. opposed the prayer for bail to the appellant.
Considering the facts and circumstances of the case and without commenting upon merits of the case, I consider it to be a fit case for bail.
Pending appeal, the appellant Anil Kumar shall be released on bail in the aforementioned case on his executing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine, if any, shall remain stayed.
