Heard Sri Abhishek Misra, holding brief of Mr. K.M. Mishra; learned Standing Counsel for respondent nos. 1 and 2 and Sri S.N. Mishra for respondent nos. 3 and 4.

Learned counsel for respondent nos. 3 and 4 submits that charge-sheet has now been issued to the petitioner in the month of April, 2012. He also states that respondents shall take all steps to conclude disciplinary proceedings against the petitioner expeditiously.

Considering the fact that delay in departmental proceedings is not attributable to petitioner, in my view, it is a fit case to be disposed of with a direction to respondent nos. 3 and 4 to conclude departmental enquiry within 4 months from today.

I order accordingly.

Till the conclusion of enquiry, as it has already got delayed, the suspension order passed against petitioner shall continue to remain stayed.
