Dr. L.P. Misra, learned counsel for the petitioner submits that the petitioner was promoted on the post of Company Commander which is equivalent to the post of Reserve Inspector on 08.04.1995 whereas the opposite party No. 5-Sanjay Choudhary was promoted as Reserve Inspector on 28.07.1995.

In the combined seniority list prepared by the Department, after completion of training on the post of R.S.I., Sanjay Choudhary was placed at Serial No. 440 whereas the petitioner was placed at Serial No. 1004. 

The contention of learned counsel for petitioner is that the petitioner being senior to opposite party No. 5 was entitled to be placed between Serial No. 12 & 13 in the said list.

Mr. Sanjay Choudhary has been promoted as Deputy Superintendent of Police on 7th July, 2006 whereas the petitioner has not been considered till date for the said promotion.

Learned Standing Counsel prays for and is allowed two weeks' time to file counter affidavit positively indicating therein as to what was the criteria in preparation of the Combined Seniority list by the department for promotion to the post of Deputy Superintendent of Police in 2005-06.

List immediately after two weeks.
