CIVIL MISC. SUBSTITUTION APPLICATION.

Sri Varchasva Bajpai, Advocate holding brief of Sri A.K. Mishra, Advocate states that Sri A.K. Mishra, Advocate has instruction on behalf of the legal heirs of appellant no. 1. Therefore, no notice is required to be issued.

Appellant no. 1 died on 20.1.1997 leaving behind his heirs mentioned in paragraph-2 of the affidavit. In view of the above, the application is allowed. In front of the name of appellant no. 1, the word dead be mentioned and his heirs mentioned in paragraph-2 of the affidavit be substituted/impleaded as the appellants. The substitution be carried out within two weeks.

Learned counsel for the appellants states that he has filed one substitution application in the year 2004 for the substitution of legal heirs of appellant no. 3. The said application is not on record. Office is directed to place the substitution application on record and list the matter in the next cause list if possible.
