Two applications have been filed - one for condonation of delay in filing the restoration application, and the second praying for recall of the order dated 18.7.2011 by which the special appeal was dismissed for non-prosecution.

The ground taken in the application for condonation of delay is that the case could not be marked on 18.7.2011, hence no one could appear on behalf of the appellant when the case was taken up.

Cause shown in sufficient. The delay is condoned. Delay condonation application is allowed.

The order dated 18.7.2011, dismissing the appeal for non-prosecution, is recalled.  The appeal is restored to its original number.

List before an appropriate Bench.

The appeal will not be treated as tied up to this Bench.
