The petitioner claims to have been engaged as a Cook in the Police Station, Karchhana, District Allahabad by the oral order issued on 8th July, 2004. He claims that he has been working as such and has been paid certain amount by the Station House Officer, Police Station Karchhana, District Allahabad but the remaining amount has not been paid from 8th July, 2004. This petition has been filed with a direction upon the respondents to take a decision regarding payment of salary and other benefit to the petitioner from 8th July, 2004.

Learned Additional Chief Standing Counsel appearing for the respondents states that the petitioner is not entitled to any relief as he was never selected as a Cook in accordance with the procedure prescribed under the U.P. Police Group 'D' Employees Service Rules, 2009 and nor any appointment order was issued to the petitioner.

The submission advanced by learned Additional Chief Standing Counsel has force. The petitioner has also stated in paragraph 5 of the writ petition that he was appointed as a Cook by means of an oral order dated 8th July, 2004.

In the absence of any appointment order having been issued to the petitioner, no relief can be granted to the petitioner.

The writ petition is, accordingly, dismissed.
