Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
Learned counsel for the applicant submitted that First Information Report was lodged after a week of the alleged incident and recovery of the golden chain has been shown two days after lodging of the FIR, from the possession of the applicant. The applicant has falsely been implicated in the present case due to enmity with the complainant and party bandi. The applicant is in jail since 24.6.2011. He further submitted that if applicant will be released on bail, he will not misuse the liberty of bail and will cooperate with the trial.
Learned AGA, vehemently, opposed the prayer for bail of the applicant.
In view of aforesaid fact without observation on merit, let the applicant namely, Parvendra Singh Chauhan, be released on bail in Case Crime No.209 of 2011, under sections 392, 411 I.P.C.., P.S. Rakabganj, District-Agra on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
