In compliance of Court's order D. I. O. S., Gonda, is present in person before this Court. Bailable warrants were issued to ensure his presence. He says that the information sent by the learned Standing counsel could not reach to him, otherwise bailable warrants would not have been issued. He apologies the lapse.

Since the Officer has appeared and has given explanation, that portion of the order  issuing bailable warrant, is recalled.

The D. I. O. S. has stated that the current salary of the petitioner has been given. The petitioner is already working there. Hence there is no question of any joining. So far as the arrears of salary of the petitioner is concerned, he has sent  necessary papers for the grant of the budget to the Director.  As soon as the budget is granted, the payment shall be made to the petitioner.

Pt. S. Chandra, has filed his Vakalatnama, on behalf of opposite party no. 2, which is taken on record. He prays for and is two weeks' time to file counter-affidavit.

Rejoinder-affidavit, if any, may be filed within a week thereafter.
