An order was passed in the writ petition on 07.10.2010, which has not been complied with.

An supplementary affidavit has been filed, in which annexure-S.A. -1 has been annexed. This is a letter from the Superintendent Engineer to Additional Director (Treasury & Pension) , Faizabad Road, Lucknow. This is a letter, which has request the Additional Director, to issue authority letter. Till date, this is only the request, but  actually the orders have not been complied with.

On 15.09.2011, it was directed that in case the orders are not complied with,  Principal Secretary, Public Works Department, shall appear in person before this Court. Neither he is present nor exemption application has been moved and nor the orders also have not been complied with.

This Court feels that there is a prima facie  case of committing contempt of this Court against the Principal Secretary.

Let the Principal Secretary, Public Works Department, appear in person before this Court on 20.10.2011 at 10.15 A.M.  to explain why the proceedings should not be initiated against him for willful disobedience of the of  the Court's  order.

This order shall be communicated by the C.S.C. office.
