Learned counsel for hte applicants is not present.

Heard learned A.G.A. and perused the record.

This application has been filed with a prayer to  quash the order dated 13.5.2009 passed by learned Special C.J.M. (C.B.I), Lucknow in complaint case No. 331 of 2009 whereby learned Magistrate has taken the cognizance and summoned the applicants to face the trial under sections 147, 323, 504 IPC.

From the perusal of the record it appears that learned Magistrate concerned has taken the cognizance  after perusing the complaint and statement recorded under sections 200 and202 Cr.P.C. There is no illegality in the impugned order dated 13.5.2009. The prayer for quashing the same is refused.

However, considering the submissions made by learned counsel for the applicants,  it is directed that in case the applicants appear before the court concerned within 30 days from today and apply for bail, the same shall be heard and disposed of on the same day by the courts below.

The interim order, if any is hereby vacated.

With this direction, this application is finally disposed of.
