Heard learned counsel for the appellants, learned A.G.A. and perused record.
Admittedly, there is cross case between the parties and persons of both sides have sustained injuries. The appellant No1. is in Jail since more than a year. The appellant No.2 Manisha Begum and appellant No.3 Gulfan Nisha have already been released on bail.
Hence, let appellant No.1 Sahabuddin be released on bail during pendency of appeal subject to furnishing of sureties of Rs.20,000/- each and a personal bond of the like amount to the court concerned in S.T. No.683 of 2006 arising out of Case Crime No.58 of 2004, convicted under Section 308 IPC for 3 years rigorous imprisonment and a fine of Rs.3000/- in case of default of fine one month additional imprisonment more and Section 324 IPC for 2 years imprisonment and a fine of Rs.1000/- in case of default of fine 15 days additional imprisonment more and Section 325 IPC for 2 years imprisonment and a fine of Rs.1000/- in case of default of fine 15 days additional imprisonment more and Section 323 IPC for 5 months imprisonment and a fine of Rs.500/- in the case of default of fine 10 days additional imprisonment more.
The fine shall be deposited in a month.
