Respondents were allowed to file counter affidavit by Courts order dated 17.3.2010, 7.7.2010, 23.11.2010, 19.1.2011, 4.4.2011 and 12.5.2011 yet no counter has been filed so far. The above indulgence granted by this Court and inaction on the part of respondents show their apathy to the Court cases. It is really unfortunate that on account of inaction on the part of respondents, the cases, which could have been decided expeditiously, are lingering on. This is really unfortunate and contemptuous in nature.
In the circumstances, I direct all the respondents to appear before this Court to explain as to why no counter affidavit has been filed though as stated above repeated opportunity has been granted to respondents to file counter affidavit.
List this matter on 4.8.2011 on which date all the respondents shall appear before this Court in person.
However, if the respondents file counter affidavit by 3.8.2011 and pay a cost of Rs. 20,000/-, they need not to appear in person.
Copy of this order shall be made available to learned Standing Counsel within 24 hours for communication to respondents and compliance.
