The petitioner is challenging the order dated 30.6.2011 passed by the District Judge, Rampur.

It appears that as an Aaganwadi worker, the process for the appointment has been initiated. As per the order of the District Magistrate itself, it is apparent that on merit the petitioner has been selected. However, the appointment letter has been issued in the name of Smt. Poonam, which has been subsequently cancelled. It appears that Smt. Poonam has filed Civil Misc. Writ Petition No. 7956 of 2011, which has been disposed of by this Court directing the District Magistrate to decide the representation of the petitioner. In the impugned order, the District Magistrate has admitted that the petitioner has been selected on the basis of the merit and inadvertently appointment letter has been issued to Smt. Poonam. The representation of Smt. Poonam has also been rejected but he gas directed the authority concerned to initiate the process of the appointment de novo. According to the petitioner, such direction is patently illegal.

Learned Standing Counsel is directed to seek instruction in the matter.
