It appears that in some of the subjects of 2nd professonal year examination, the petitioners were failed. The petitioners are entitled to appear in Supplementary Examination.
The grievance of the petitioner is that despite the letter being written by the College, the respondent nos. 2,3 and 4 are not taking the supplementary examination. The petitioners are also seeking a direction to respondent no. 3 and 4 to permit the petitioners to appear in Bachelor of Dental Surgeon IIIrd Year Examination 2011.
So far as relief no. 1 claimed by the petitioner seeking a direction to permit the petitioners to appear in Bachelor of Dental Surgeon IIIrd Year Examination 2011 is concerned, such relief cannot be granted inasmuch as the petitioners are admittedly failed in some of the papers of the 2nd year examination.
Learned counsel for the petitioners is not able to show any provision in which the petitioners can be allowed to appear in the examination provisionally.
So far as second relief is concerned, Sri Shailendra, learned counsel for the respondent nos. 2,3 and 4 may seek instruction that when the University is able to take the supplementary examination in respect of those subjects in which the petitioners failed.
