Heard learned counsel for the petitioner and Mr. Vishal Verma, learned counsel for opposite parties 2 and 3 as well as learned Standing Counsel.
The petitioner being Shiksha Mitra is seeking permission for training on the basis of qualification obtained during the course of service. However, I am of the view that unless she is permitted by the employer for study during the course of service, the same cannot be acknowledged by the department.
Since the petitioner confines her prayer to issue a direction to the Assistant Basic Education Officer, Gonda i.e. opposite party no. 3 to consider and dispose of the petitioner's representation, at this stage, I hereby issue a direction to opposite party no. 3 to consider and dispose of the petitioner's representation within two months after receipt of a certified copy of this order. The petitioner is permitted to move a representation before opposite party no.3.
The writ petition is accordingly disposed of finally.
