In a joint announcement on Friday, tobacco giants Philip Morris International (PMI) and British American Tobacco (BAT) disclosed their agreement to settle many ongoing patent infringement disputes surrounding their respective cigarette alternatives. The resolution comes after a protracted and multifaceted legal battle detrimental to both corporations.
BAT, renowned for its production of Vuse vapes and Glo heated tobacco devices, found itself obligated to pay PMI millions of dollars following a legal defeat. Simultaneously, PMI faced restrictions on importing its flagship heated tobacco device, IQOS, into the United States due to a separate case.
As company statements and filings outlined, the comprehensive settlement is non-monetary and global, extending over an eight-year period. One of its key provisions is dismissing all pending patent infringement cases, thereby ending the ongoing legal skirmishes. Furthermore, the agreement safeguards both parties against any future claims related to their existing products.
According to a filing with the Securities and Exchange Commission by PMI, the settlement includes a request to remove the ban on importing IQOS into the United States. This marks a significant triumph for PMI, aiming to bring the innovative device to the American market later this year.
PMI CEO Jacek Olczak expressed satisfaction with the resolution, stating, "We are pleased that this matter has been resolved to the mutual satisfaction of both parties." CEO Tadeu Marroco commented on the BAT side, "This agreement is an important step forward for BAT and all of our stakeholders," emphasizing that it will enable the company to concentrate on innovation.
Both companies highlighted that the agreement not only resolves current disputes but also provides flexibility for introducing future generations of their products. The collaborative settlement signals a turning point for PMI and BAT, allowing them to move beyond legal entanglements and focus on advancing their respective technological innovations in the tobacco alternative market.
