The Gauhati High Court recently comprising of a bench of Chief Justice Sudhanshu Dhulia and Justice Soumitra Saikia sought the response of the Government of Assam over its failure to establish a Transgender Welfare Board and a Transgender Cell in the State. (All Assam Transgender Association v. State of Assam and Others)
Facts of the Case
This writ petition was filed by the All Assam Transgender Association, which is a registered body. As per the petitioner, under the law, a Transgender Welfare Board and a Transgender Cell are liable to be established in the State of Assam. All the same, this has not been done.
Courts Observation & Judgment
The bench taking note of the same issued notice, returnable on 18th February 2022.
The bench remarked that Since Mr. M. Chetia, learned Junior Government Advocate, Assam, accepted notice on behalf of all the respondents, no formal steps need be taken and therefore directed the respondents to file their reply within three weeks.
It should be remembered that the Supreme Court gave notice in a PIL in April 2021, "seeking the creation of a Transgender Welfare Board and establishing a Standing Committee to investigate gross abuse against trans-persons by police”.
The court had sought responses from the Centre and the states in response to a petition filed by the Kinner Maa Eksamajik Sanstha Trust, which sought directives to form a transgender welfare board to address the trust's social welfare concerns.
