The single judge bench of Justice Rajeev Ranjan Prasad of the Patna High Court in the case of Ravi Anand Vs The state of Bihar held that having B.Tech in Electrical Engineering combined with M.Tech in Information and Communication Technology cannot be declared equivalent to M.Tech in Electrical Engineering.
Brief facts
The factual matrix of the case is that the results were published by the respondent BPSC for the appointment of the post of Assistant Professor (Electrical Engineering) and in which the petitioner was declared ineligible for the post. The writ petition is filed to direct the respondent to consider the petitioner eligible for the post of Assistant Professor (Electrical Engineering) who holds the Degree of the integrated course i.e. B.Tech in Electrical Engineering and MTech in Information and Communication Technology (Five years).
Contentions of the Petitioner
The learned counsel for the Petitioner submitted that the petitioner was ineligible because he had done post-graduation in MTech in Information and Communication Technology and not of MTech. in Electrical Engineering. It was furthermore submitted that the petitioner completed an MTech in Information and Communication Technology, which was designed by the Indian Institutes of Technology in Delhi and is taught in the Electrical Engineering Department; as a result, his postgraduate degree should be regarded as being equivalent to an M.Tech in Electrical Engineering.
Contentions of the Respondent
The learned counsel appearing on behalf of the Respondents submitted that in the notice issued by the AICTE, it has been made clear that the Board of Governors (BoG) of the concerned institution may make the appropriate decision regarding relevant qualifying degrees suitable for recruitment to teaching positions, especially keeping in mind the interdisciplinary nature of emerging technologies, on the recommendation of the duly constituted Selection Committee and with the approval of their respective State/UT/Central Government/University/DTE etc. as applicable. Furthermore, it is nowhere mentioned in the writ application that the syllabus of the MTech in Electrical Engineering and that of the MTech in Information and Communication Technology is the same and one.
Observations of the Court
The Hon’ble Court relied upon the judgment titled Unnikrishnan CV and Others versus Union of India and Others.
The Hon’ble Court observed that it is not possible to determine that the petitioner, who holds a B.Tech in Electrical Engineering combined with an MTech in Information and Communication Technology, is comparable to an MTech in Electrical Engineering.
The decision of the court
With the above direction, The Hon’ble Court dismissed the writ application.
