The single-judge bench of Justice Rajesh Bhardwaj of the Punjab and Haryana High Court in the case of Inderjit Singh Vs State of Punjab granted regular bail to the accused in case FIR registered under sections 304-B, 201 and 34 of IPC and Section 302 IPC.

BRIEF FACTS

The factual matrix of the case is that the deceased was married to an Inderjit on 29/10.2017 and alleged that the father of the deceased have given enough dowry and stridhan more than his capacity during the marriage. However, after the marriage, she faced harassment from her in-laws because of dowry. She used to be given beatings for bringing less dowry. Thereafter, he got the news that his daughter has committed suicide by hanging. The present FIR was lodged for taking the legal action against the accused persons.

The father of the petitioner has submitted before the hon’ble court that petitioner has been falsely implicated in the present case. It was further submitted that they tried their level best to solve the matrimonial dispute but the deceased was not happy with the decisions taken by her parents. It was also submitted that though the suicide was taken place in the matrimonial home only but this was not on account of harassment for dowry. It was also argued that the allegations in the FIR are very general in nature and even the co-accused were granted bail.

COURT’S OBSERVATION

The Hon’ble High Court held that the marriage took place in the year 2017 whereas, the death took place on 03.09.2020. The petitioner is behind the bars since 05.09.2020. The co-accused have already been granted bail by this Court. The veracity of the allegations and the counter-allegations is totally in the domain of the trial Court which would be appreciated after the evidence is led by both the parties.

The trial of the case will take sufficient time and no useful purpose would be served by keeping the petitioner in custody for further period. Whether in the facts and circumstances of the case presumption under Section 113-B of Evidence Act is attracted or not is a debatable issue. However, the court granted bail to the accused.
