This seminar focuses on the growing importance of Alternative Dispute Resolution (ADR) mechanisms in ensuring effective, affordable, and timely justice in contemporary society.
With the increasing burden on courts, prolonged litigation, high legal costs, and procedural complexities, ADR has emerged as an efficient alternative to the traditional judicial process.
The seminar aims to examine various forms of ADR, including arbitration, mediation, conciliation, negotiation, and Lok Adalat, and their role in promoting access to justice. It highlights how ADR mechanisms help reduce judicial backlog, save time and expenses, preserve relationships between parties, and encourage amicable
settlement of disputes.
The seminar also explores the constitutional perspective of access to justice in India, particularly the principles of equality, fair trial, and speedy justice under Articles 14 and 21 of the Constitution.
Special emphasis is placed on the legal framework governing ADR in India, including the Arbitration and Conciliation Act, 1996, the Legal Services Authorities Act, 1987, and recent developments under the Mediation Act, 2023.
Further, the seminar discusses emerging trends such as Online Dispute Resolution (ODR), digital justice systems, and India’s efforts to strengthen institutional arbitration and mediation practices. It also critically analyzes the challenges faced by ADR mechanisms.
Overall, the seminar seeks to provide a comprehensive understanding of how ADR serves as an important instrument for achieving accessible, efficient, and participatory justice in modern legal systems.
Selected Papers will be published as Seminar Proceedings bearing an ISBN. Authors of the selected papers are required to pay Rs. 1000/- towards publication charges.
