The Rajasthan Homoeopathic Medicine Board (Teachers and Fees) Regulations, 1973

In exercise of the powers conferred by Clauses (e) and (f) read with clause (m) of sub-section (1) of section 58 of the Rajasthan Homoeopathic Medicine Act. 1969 (Rajasthan Act 1 of 1970), the Board hereby makes the following regulations, the same having been previously published in the Rajasthan Gazette, Part 3(B), dated the 29th June, 1972. These regulations have also been confirmed by the State Government.
- Short title and commencement.- (1) These regulations may be called the Rajasthan Homoeopathic Medicine Board (Teachers and Fees) Regulations, 1973.
(2) They will come into force on the date of their publication in the Rajasthan Rajpatra.
- Definitions.- In these regulations unless the context otherwise requires,-
(a) "Act" means the Rajasthan Homoeopathic Medicine Act, 1969:
(b) "Board" means the Rajasthan Board of Homoeopathic Medicine, constituted under the provisions of the Act;
(c) "Course of Study" means a course of study and curricula duly prescribed by the Board under section 40(ii) of the Act:
(d) "Institution" means a Homoeopathic educational or instructional Institution and unless the context otherwise requires includes an affiliated institution;
(e) "prescribed" means duly prescribed by the Board:
(f) "Recognised or affiliated" means recognised by the Board for the purposes of affiliation;
(g) "Regulations" mean the regulations framed by the Board under the Act:
(h) "Rules" mean the rules framed by the Government under the Act;
(i) "section" means a section of the Act:
(j) "Teacher" includes Principal, Vice-Principal, Professor, Assistant Professor, Lecturer, Assistant Lecturer and Demonstrator:
(k) Words and expressions used but not defined in these regulations shall have the meanings assigned to them in the Act.
- Number of teachers.- (1) Every institution shall have a Principal as the Head of the institution, and such number of other teachers as may be prescribed by the Board.
(2) The number of teachers for each course of study in an affiliated institution shall be such as may be prescribed by the Board from time to time in the Regulations pertaining to a course or study or otherwise, provided that the number of teachers in an affiliated institution shall in no case be less than fifteen:
Provided also that a majority of the teachers shall be Homoeopaths.
(3) Ordinarily a class shall not consist of more than forty students and ordinarily there shall be a separate teacher for each subject for a class of forty students or less than forty students:
Provided that a teacher qualified to teach a subject to more than one class in more than one course of study may be employed by an institution.
- Qualifications of teachers.- Teachers appointed for teaching subjects included in a course of study in an affiliated institution shall have such minimum qualifications as may be prescribed by the Board in the Regulations pertaining to the course of study or otherwise.
- Emoluments of teachers.- (1) An institution shall pay to its teachers such salaries and allowances as may be prescribed by the Board from time to time.
(2) Until emoluments of teachers appointed in institutions affiliated to the Board are prescribed by the Board, an institution shall pay to its teachers such emoluments as may be prescribed by the institution.
- Maintenance of Registers.- (1) Every institution shall maintain a register of its teaching staff showing therein the names and permanent addresses of all members of its teaching staff, their educational and other qualifications, subjects for which appointed, nature of their appointments i.e. whether whole time or part time, dates of birth, dates of appointment in the institution, scales of pay in which appointed, allowances etc. payable in and such other information as may be prescribed by the Board.
(2) Every institution shall maintain an attendance register in which all the teachers employed by an institution shall on all working days mark their attendance.
(3) Every institution shall maintain a salary payment register for its staff in which payments of monthly salary, pay and allowances etc. to each member of the staff shall be indicated and his receipt obtained in token of having received the same.
- Fees to be charged by an institution.- (1) A person admitted to a course of study shall, before he is admitted to the studentship of the institution, pay to the institution such tuition fee and other charges as may be prescribed.
(2) A student admitted to a course of study shall for the duration of the course pay to the institution such tuition fee and other charges as may be prescribed, before such time as may be prescribed.
(3) The tuition and other fees payable to an institution for a course of study shall be such as may be prescribed by the Board from time to time in the regulations pertaining to that course of study or otherwise.
(4) No sum, fee, charge etc. not prescribed or authorised by the Board shall be paid to an institution by a student and no such amount shall be demanded or levied or recovered from a student by an institution.
- Fees for Board's examination.- (1) No student shall be admitted to an examination of the Board unless he has paid the prescribed fee therefor to the Board.
(2) The examination fees for each examination of the Board shall be such as may be prescribed by the Board in the regulations pertaining to the course of study or otherwise.
(3) Examination fee once paid to the Board shall in no case be refundable.
