No.2978-R A R-II-1/2006-En. - In exercise of the powers conferred by Clause (i) of Section 180 read with Section 106 of the Electricity Act, 2003 (36 of 2003), the State Government do hereby make the following rules, namely :-
- Short title and commencement.- (1) These rules may be called the Orissa Electricity Regulatory Commission (Budget) Rules, 2006.
(2) They shall come into force on the date of their publication in the Orissa Gazette.
- Definitions.- In these rules, unless the context otherwise requires,-
(a) "Act" means the Electricity Act, 2003;
(b) "Annual Financial Estimates or Budget" means the statement of estimated receipts and expenditure of the Commission;
(c) "Appendix" means an Appendix appended to these rules;
(d) All other words and expressions used in these rules but not defined and defined in the Act shall have the same meaning respectively assigned to them in the Act;
- Budget preparation.- The Commission shall prepare its budget in each financial year for the next financial year commencing from 1st April to 31st March.
- Account heads.- The Budget of the Commission shall be prepared under appropriate Heads of Account as listed in the Appendix I to these Rules.
- Budget Format.- The Commission shall prepare its Annual Financial Statement (estimate receipts and expenditure) under each major Head for the ensuring financial year, in the Format appended to these rules at Appendix II.
- Forwarding the Budget.- (1) The Commission shall forward the State Government its Annual Financial Statement in December each year for the ensuing financial year.
(2) The Commission may at any time during the year in respect of which a statement under sub-rule (1) above of these rules has been forwarded; send a supplementary statement to the State Government in the format as appended to these rules at Appendix III for the current financial year.
- Removal of the difficulties.- If any difficulty arises in giving effect to any provision of these rules, the State Government may, by order, make such provisions not inconsistent with the provisions of the Act and these rules, for removing the difficulty.
