R.& F.D.No. UNF. 2667-R(11-3-1968). - In exercise of the powers conferred by Section 306 of the Maharashtra Land Revenue Code, 1966 (Maharashtra XLA of 1966), and in supersession of all previous rules made in this behalf and continued in force by virtue of the third proviso to Section 336 of the said Code, the Government of Maharashtra hereby makes the following rules, the same having been previously published as required by sub-section (1) of Section 329 of the said Code, namely:

  1. Short title.- These rules may be called the Maharashtra Land Revenue (City of Bombay) Rules, 1968.
  2. Definition.- In these rules the context otherwise requires,-

(a) "Code" means the Maharashtra Land Revenue Code, 1966.

(b) "section" means a section of the Code.

  1. Upset price may be fixed.- Where any land or other property is to sold by public auction under the provisions of Chapter XIV of the Code, an upset price may, if the Collector thinks fit, be placed thereon.
  2. Court fees.- Every appeal before the Maharashtra Revenue Tribal filed under Section 274 shall bear a Court-fee stamp of Rs. 20.
  3. Copy of appeal to be sent to the Collector.- Where an appeal is filed be before the Maharashtra Revenue Tribunal, the appellant shall forward a copy of the appeal to the Collector within three days of the filing of such appeal.
  4. Survey fees.- (1) The Survey fees payable under Section 285 shall ordinarily be so fixed by the Collector that the total sum payable in respect of the site under survey shall cover the cost of the survey and preparation of maps and registers which are required to be prepared under Section 282.

(2) In fixing the fees for each building site or any portion thereof held separately, the Collector shall have regard to the provision of sub-rule (1) and to the position, value and area of such building site or portion thereof.
