In exercise of the powers conferred by sub-section (1) and clause (f) of sub-section (2) of Section 51 read with Section 15 of the Madhya Pradesh Homoeopathy Parishad Adhiniyam, 1976 (No. 19 of 1976), the State Government hereby makes the following rules namely :-

  1. These rules may be called the Madhya Pradesh Homoeopathy Parishad (President, Vice-President and Members) Travelling Allowance and Other Remuneration Rules, 1977.
  2. The State Government hereby accords sanction to grant of allowance under the Madhya Pradesh Homoeopathy Parishad Adhiniyam, 1976, as from the date of coming into force of the said Act at the rates specified in and in accordance with the rules hereinafter appearing.
  3. (1) The President, Vice-President and every member shall for the journey undertaken by them in connection with the discharge of the duties for the performance of the work of the Council be entitled to travelling allowance and daily allowance at the following rates, namely :-

(a) Travelling allowance. - For Journey,-

(i) by railway-a single first class fare for the places connected by rail;

(ii) by road :-

(a) a single first class fare for the maximum distance connected by rail; and

(b) for the remaining distance 00.36 paise per kilometre for the first 120 kilometres and 00.26 paise per kilometre thereafter :

Provided that no travelling allowance shall be payable for a journey to a place within a distance of 8 kilometres from the place wherefrom the journey is undertaken.

Note. - The ordinary mode of travelling between places connected rail is that which travellers generally use namely, the railway. The use of a regular motor service or a car may be allowed for a journey between places connected by rail provided the journey is considered to be short (by time) or necessary in the interest of public service, for example, where a car is required for extensive touring at the other end of the journey off the railway line for urgent inspection and enquiries or where inspection on route is involved in urgent cases in which travelling by train would cause undue delay.

(b) Daily allowance. - (i) At Rajbhogi towns in Madhya Pradesh, at the rate of Rs. 22.50 per day; (ii) at places other than Rajbhogi towns in Madhya Pradesh, at the rate of Rs. 15.00 per day; (iii) at Delhi, Bombay, Calcutta, Madras, Bangalore, Hyderabad and such other places as the State Government may by order, specify and such hill stations as the Council may specify, at the rate of Rs. 40.00 per day; (iv) at places outside Madhya Pradesh other than the places specified in sub-clause (iii) at the rate of Rs. 30.00 per day:

Provided that for a stay of less than twelve hours, daily allowance at half the rates shall be payable.

(c) Incidental charges. - Charges to cover the incidental expenses during travel shall be admissible at the following rates, namely,-

(a) for journey exceeding six- hours but not exceeding twelve hours at the rate of Rs. 7.50 per day;

(b) for journey exceeding twelve hours but not exceeding twenty-four hours at the rate of Rs. 15.00 per day;

(c) for journey exceeding twenty-four horns at the rate of Rs. 15.00 per day for each complete block of twenty-four hours.

Note. - The duration of journey shall be entire period spent on outward and inward journeys taken together.

(d) Headquarter allowance. - The headquarter allowance to cover porter and transport charges shall be paid at the rate of one-half of the daily allowance admissible at the place of headquarter on the day of departure and arrival.

(e) Special halt allowance. - Special halt allowance to cover porter and transport charges shall be paid at the rate of one-half of the daily allowance admissible at the place of halt on the day of arrival and departure :

Provided that if the date of arrival and departure falls on the same day only one-half of the daily allowance shall be admissible.

  1. (1) An office bearer or a member residing at the place of meeting shall be paid conveyance allowance only at the rate of Rs. 15.00 per day to meet conveyance expenses.

(2) Every member including those who reside at the place of meeting shall be paid meeting allowance at the rate of Rs. 20.00 per day each day or part thereof on which he attends meeting of the Council or any of its committees within the State and at the rate of Rs. 40.00 per meeting held outside the State :

Provided that conveyance allowance, meeting allowance and daily allowance, as the case may be, shall not be payable simultaneously and that allowance shall be payable which is at a higher rate :

Provided further that if a member attends more than one meeting on the same day, allowance shall be payable only for one meeting.

  1. No claim for travelling allowance or daily allowance under these rules shall be admissible if such allowance have been claimed for the same journey from any other source.
  2. All allowances payable under these rules shall be claimed by presenting a bill in the form appended to these rules within a period not exceeding twelve months from the day on which they become due for payment.
  3. Where the place of residence of the President is at the headquarters of the Council, he shall be paid, a conveyance allowance at the rate of fifty rupees per month.
  4. If any dispute arises with respect to the interpretation of these rules, the decision of the State Government shall be final.
