High Court lists Dr. Kafeel’s matter for final disposal [Read Order]

The Allahabad High Court while dealing with the matter related to Dr. Kafeel Khan has fixed the writ petition in the nature of habeas corpus filed against alleged illegal detention of Dr. Kafeel Khan, for final disposal on 24August, 2020.

A writ petition was filed before the Supreme Court of India by the mother of Dr. Kafeel Khan to pass a writ in the nature of Habeas Corpus ordering the immediate release of the Dr. Kareel Ahmad Khan, who is illegally placed under detention at the District Jail, Mathura under Section 3(2) of the National Security Act, 1980 in an egregious violation of his right to life and personal liberty as well as in a grave abuse of power and authority and to pass an appropriate order quash all the orders passed by Aligarh district Magistrate.

The Apex Court has dismissed the plea and passed direction that present matter must be taken up by Allahabad High Court.

“We consider it appropriate that the matter be taken up by the Allahabad High Court. The record of the matter be transmitted to the High Court forthwith.” Supreme Court said.

Considering the above direction of the Apex court the matter has taken up by the Allahabad High Court and Division bench of Chief Justice Govind Mathur and Justice Samit Gopal has grant time period till Monday to Respondent to file Counter- Affidavit.

The matter is listed on 24^th August for the final hearing.

On the last hearing of the present matter the Allahabad High Court sought response of the UP state government for the release of Dr. Khan.
