The Bombay High Court granted parole to a woman convicted for murder, who once returned from furlough 574 days late.
Once in a year, a furlough is granted to imprisoned convicts so that they can spend some quality time with their families and society.
The Prisoner Asha Tayade was imprisoned in Yarawada Prison in November 2007 as she was charged under section 302 of the Indian Penal Code. It was alleged that he had committed the murder of her daughter- in – law in March 2003. A petition was filed in the High Court by her sister Shobha for granting her parole in the face of the unprecedented pandemic.
Learned lawyer Rupesh Jaiswal argued that she shall be granted parole as she had surrendered herself earlier only after 524 days. He said she had served 12 and a half years of “ actual imprisonment” and with remission, she has completed 19 years behind the bars.
The lawyer was of the view that she would “ not commit any breach of parole”.
The Bench of Justices R.D. Dhanuka and V.G. Bisht accepted the arguments of the lawyer and stated that,
“ only one solitary incident of breach of furlough leave amounting to 574 days”, in view of the “ pandemic situation she deserves to be released for 45 days under emergency parole leave.”
Therefore, the High Court granted parole to her after she had surrendered herself earlier when she was granted parole. On account of her conduct, she was once again granted parole.
