HC seeks reply of state in matter of release of Dr. Kafeel khan [Read Order]

The Allahabad High Court while dealing with the writ petition regarding the release of Dr. Kafeel Khan has asked the State of Uttar Pradesh/ Respondent to positively file its reply to amend petition by the next date of hearing.

The present habeas corpus writ petition has filed mother of Kafeel Khan against alleged illegal detention of Dr. Khan.

The counsel on behalf of the state has requested to the court that he has get the copy of amend petition on last Friday, therefor he need time of 10 days to file reply to the amend petition.

The High Court Bench comprised of Justice Manoj Mishra and Justice Deepak Verma has allowed the request of the counsel of state and grant time period of 10 days to file a reply to petition.

The Court has listed the matter on 19 August, 2020 and directed that the reply of state must be filed by August 19, 2020. The court has also directed to Union of India to file its counter offer if it required.

“Put up this petition on 19th August, 2020, by which date positively reply to the amended petition be filed. In the meantime, Union of India may also file counter affidavit.” The court stated.

The court has also directed that the counsel of petitioner must be informed in written about this order within 48 hours.
