The High Court of Punjab and Haryana dealt with a PIL instituted against the banned organization, “Sikh for Justice”, and also directed the State and the Central Government to take proper action against the same.
Case of the Petitioner
The abovementioned PIL was filed by Advocate Bikramjit Singh Bajwa, wherein he stated that the organization has become suddenly active with the motive of hampering the public order by demanding a separate State for Sikhs i.e. Khalistan.
It was further stated that the organization has initiated with all sorts of anti-national activities thus interfering with public peace and tranquility and is also instilling in the residents of Punjab, particularly in the youth of the State the feeling of disaffection against the Government and urging them to declare the war against the State Government.
Case of the Respondent
Additional Solicitor General appearing from the Union of India assured the court that proper steps are being taken to block the proposed “referendum” being taken by the organization. They further stated that they cannot disclose the course of action being taken for security reasons.
Observation of the Court
“The petition filed by the petitioner is disposed of with a direction that necessary action be taken by the authorities. The information available with the petitioner may be over analyzed and necessary steps for dealing with the threat perception is taken, if so required.”
The Bench further assured that in case the Petitioner is facing any sort of threats which in turn is undermining his security and liberty, then the Government has asserted that strict actions will be taken against the organization if any such threatening facts come to the light or are reported by the petitioners to the police authorities, there will be immediate action taken after assessing the threat alleged by the Petitioner against the organization, this was claimed by the Government.
Sikh for Justice was banned by the Government on July 10, 2019 and the head of the organization, namely, Gurpatwant Singh Pannu was declared as “designated terrorist” by the Government of India on July 1, 2020. As per the claim of the Government 116 Whatsapp group associated with the organization are banned and as many as 16 FIRs have been registered against the organization.
