The contempt petition was moved by two minor children of Richmond Global School, through their fathers. They had filed a writ petition in the court for baseless fee hike undertaken by the school and the subsequent denial to attend online classes, wherein the court on 21st July 2020 held that the students must be given access to school portals to attend online classes and the Petitioners would pay the fees payable as per Circular of the Government.
Despite the order being served the petitioners were not given access to the online portal. The outstanding fees due from Petitioners were also not communicated to them. Notice was issued in the contempt petition to the Principal and Chairman of School through SHO. It was submitted by the respondents that due to personal reasons the Principal was not able to access the email earlier but as of 2nd August 2020 both students were given the access and the outstanding fees were also paid.
Keeping the personal reasons of the Principal in mind, the court exempted the Principal and Chairman however the court stated that there was a clear lapse by the School in not accessing their emails during this entire period and that they did not comply with the order of the court. The court thus ordered the school to waive one months’ tuition fees of the petitioner. The court also asked the school to conduct a re-test for any missed examination and provide them with course material within one week so that the students don’t suffer in any way.
