The Allahabad High Court while dealing with a Public Interest Litigation directed the petitioner to first approach to the Registrar General in respect to the demand of utilization of A-4 size paper with printing on both sides in official as well as judicial functioning in all the courts across the state of Uttar Pradesh.
"The petitioner however, is at liberty to submit a detailed demand notice to the respondents and on denial of that or having no result thereon within a reasonable time, the petitioners may approach under Article 226 of the Constitution." directed by court.
Saumitra Anand filed this petition before the court to issue a writ in the nature of mandamus with the view to pass direction to Registrar General of Allahabad High Court for utilizing A-4 size paper with printing on both sides in official as well as judicial functioning.
The High Court Bench Comprised of Chief Justice Govind Mathur and Justice Ramesh Sinha after noting the gravity of issue observed that “the issue sought to be agitated by the petitioners requires serious consideration in administrative side. It is also well settled that the condition to have a writ in the nature of mandamus is that a person demanding such writ must first approach the authority concerned against whom relief is sought."
The Court observed that the petitioner had not approached to the concerned authority to get relief before filing the writ petition before the court. The bench with this view dismissed the petition and held that; "the petitioners before approaching this Court have not satisfied such condition precedent. In view it, we are not inclined to interfere in the matter at this stage."
