Colonial hangover in Service Law? SC orders Fresh Look at Coast Guard Retirement framework

The Supreme Court has directed the Union government to constitute an expert committee to re-examine the retirement age and service conditions of Coast Guard personnel, even as it stayed a Delhi High Court ruling that had equalised the retirement age across ranks. The order puts colonial-era service norms under judicial scrutiny at a time when the Centre has publicly committed to phasing out outdated legal frameworks.

The direction came from a Bench led by Chief Justice Surya Kant and Justice Joymalya Bagchi while hearing the Centre’s appeal against a High Court judgment that struck down Rules 20(1) and 20(2) of the Coast Guard (General) Rules, 1986. Those provisions mandated retirement at 57 years for officers up to the rank of Commandant and 60 years for higher ranks. The High Court had held that all Coast Guard officers should retire at 60, drawing support from its earlier ruling in Dev Sharma v. Indo-Tibetan Border Police, which removed a similar distinction in the ITBP, a decision later upheld by the apex court.

Before the Apex Court, the Centre argued that the Coast Guard, functioning under the Ministry of Defence, could not be equated with Central Armed Police Forces operating under different administrative frameworks.

While staying the High Court’s direction and temporarily restoring the differential retirement ages, the Bench made it clear that the broader issue requires systemic reconsideration. “It is high time that these regulations governing the service conditions and retirement age are reviewed. Govt cannot be stuck with the conditions envisaged and drafted in the 1940s,” the Court observed.

It ordered the Union government to set up a panel of domain experts to revisit the service framework, including retirement age, and submit a report to the Court, signalling that the final word on the issue will depend on the outcome of that review.
