SC: Only Two Years in Jail for Killing a Person on Road in Accident is too low

India looses 1.5 Lakhs Lives on Roads each Year.

Supreme Court Friday has termed punishment of two years in jail, with or without fine for causing death due to rash and negligent driving as "absolutely inadequate" and has also called for a response from the Government for an amendment under Section 304-A,Indian Penal Code.Apex Court Bench comprising of Justice Dipak Misra and Justice C Nagappan  enunciated  that, “It was a clearly a matter of concern that there was only two years in jail as the maximum term for killing a person by reckless driving… therefore it must be more”.

However Supreme Court Bench clarified that  it was conscious that legislation is domain of the Parliament but it would like hear Attorney General for India on this aspect on August 30.

Referring to earlier judgments of the Supreme Court like State of Punjab Vs Saurabh Bakshi and Dalbir Singh Vs State of Haryana, the Bench enunciated that " it is clearly indicated that the punishment provided under Section 304A, Indian Penal Code is absolutely inadequate".
