Recently, the Singapore Parliament introduced a bill to establish an International Committee within the Singapore International Commercial Court (SICC) aimed at addressing civil appeals and related matters from designated foreign jurisdictions. This initiative seeks to enhance the SICC’s capacity to manage complex transnational commercial disputes through a specialized framework.
The proposed bill designates the International Committee as an independent body operating within the SICC comprised of judges from Singapore’s Supreme Court and international judges affiliated with the SICC. As hoc members from the referring foreign jurisdictions’ courts will also participate in proceedings. The minister for Law will have regulatory authority over cases brought before the Committee, which will include civil appeals originating from recognized foreign jurisdictions. Representation will be permitted for both Singapore legal practitioners and foreign lawyers registered to appear before the SICC.
The bill emphasizes enforceability, ensuring that judgments or orders issued by the International Committee will be treated as originating from the Courts of the referring jurisdictions. This arrangement is intended to facilitate the cross-border recognition and enforcement of decisions. Additionally, decisions made by the committee will be final, precluding further appeals and ensuring timely resolution.
This legislative initiative aligns with Singapore’s recent international collaboration, including the bilateral treaty with Bahrain to establish the Bahrain International Commercial Court. The formation of the International Committee further bolsters Singapore’s commitment to providing a reliable, impartial venue for global commercial dispute resolution and reinforces its standing as an international legal hub.
