Bombay High Court Fines Premier Stationery Industries Rs 50 Lakh for Violating Fevicol Trademarks

The Bombay High Court has imposed a fine of Rs 50 lakh on Premier Stationery Industries for violating the trademarks of Pidilite Industries, the company behind the iconic Fevicol brand. The ruling came after Pidilite sued Premier for manufacturing and selling adhesive products that closely mimicked their renowned Fevicol glue bottles and glue guns.

The case was presided over by Justice Riyaz Chagla, who noted that Premier Stationery Industries had blatantly ignored a 2017 court order prohibiting the production of Fevicol knockoffs. The court's directive followed a petition from Pidilite, which highlighted that Premier's Fevicol-like products had reappeared on the market in direct contravention of the previously agreed-upon labels and bottles.

In its order, the High Court stated, "The Respondents have not offered any apology, much less an unconditional apology, and this is evident from their lack of remorse or regret for their wrongful acts and/or willful disobedience of the Court's Orders."

Pidilite, which markets a range of products under the Fevicol, Fevicryl, Fevistick, and Fevi Kwik brands, accused Premier of deliberately using glue pens, labels, and bottles that infringed upon its trademark rights. Premier, however, argued that they were unaware of the agreements made with Pidilite when they acquired the stationery company after the 2017 ruling. They contended that they should not be held accountable for the previous owner's obligations.

The High Court dismissed this argument, pointing out that there was evidence of a connection between Premier Stationery Industries' past and current owners. The court concluded that this continuity, coupled with the company's misleading representations, amounted to deliberate and willful disobedience of the court's prior order.

This ruling underscores the importance of adhering to court orders and respecting intellectual property rights in the competitive business landscape.
