On Wednesday, the Supreme Court turned its attention to the complex legal situation surrounding Kashmiri separatist leader Shabir Ahmed Shah, seeking details from the NIA on his custody across multiple criminal cases. Shabir Ahmed Shah is challenging the Delhi High Court’s refusal to grant him bail in a high-profile terror funding case.
Shabir Ahmed Shah was arrested in June 2019, faces charges of facilitating separatist and militant activities in Jammu and Kashmir, inciting public protests, paying tribute to slain militants, and raising funds through hawala and LoC trade. He is reportedly facing trial in around 24 criminal cases, many of which involve conspiracies against the central government.
During the hearing, the NIA requested additional time to file its counter-affidavit, while the Central Government’s counsel asked that individual paramilitary personnel be excluded from the proceedings, allowing only official respondents to contest the matter.
The Bench, comprising Justice Vikram Nath, Justice Sandeep Mehta, and Justice N V Anjaria, instructed that the counter-affidavit must include Shah’s custody details in all other criminal cases. The Court granted four weeks for the affidavit and listed the matter for further hearing on October 31.
