The Telangana High Court ordered the immediate release of Tollywood actor Allu Arjun from Chanchalguda Jail, emphasizing adherence to judicial directives. The court observed that any delay in executing its orders would undermine the principles of justice.
Allu Arjun had been in judicial custody since Friday following a stampede incident at Sandhya Theatre during the premiere of his movie Pushpa 2: The Rule, which led to the death of a woman and critical injuries to her son. The actor, his security team, and the theatre management were booked under Section 105 (culpable homicide not amounting to murder), 118(1) (voluntarily causing hurt), and 3(5) of the BNS Act. While a lower court had sent him to 14 days of judicial custody, the Telangana High Court granted him interim bail late in the evening, directing his immediate release. Despite the High Court's order, Arjun's release was delayed until 6:40 AM the following morning, leading to allegations of “illegal detention” by his legal team.
The counsel on behalf of Allu Arjun argued that the jail authorities deliberately delayed executing the High Court’s explicit order, which stated that the actor should be released “forthwith”. They contended that a certified copy of the order was promptly delivered to the jail authorities, both through official channels and a High Court messenger. Despite this, Arjun remained in custody for several hours, in clear violation of the court’s directive. The counsel also emphasised that the delay amounted to “illegal detention” and raised questions about the accountability of the jail authorities and the concerned government department. They announced plans to pursue legal remedies against this alleged misconduct.
The Telangana High Court expressed concerns about the delay in implementing its order observing that compliance with judicial directions is a cornerstone of the justice system. The Court remarked, “The directive was unequivocal: the individual should be released immediately. Any delay, irrespective of the circumstances, is unacceptable and amounts to a serious procedural lapse”.
Further, the court highlighted the duty of jail authorities to act swiftly upon receiving a judicial order. It noted, “The rule of law demands strict adherence to court directives. Any deviation undermines public confidence in the administration of justice.”
The bench also observed that such delays could set a dangerous precedent, emphasising that the presiding authorities must ensure timely compliance to prevent further erosion of legal standards.
The High Court reiterated its earlier order and directed the immediate release of Allu Arjun, condemning the delay as a violation of its directive. While granting liberty to the actor to pursue further legal action, the Court emphasised the necessity of accountability for the lapses observed in the case. The judgment serves as a reminder of the sanctity of judicial orders and the obligation of authorities to uphold them without delay.
